#China #AQSIQ: Clarifications concerning the protection of foreign GIs

In the framework of providing its members with information concerning the laws and procedures to register GIs in foreign jurisdictions, oriGIn offers you information and manuals, like the one concerning the BRICs countries.

With respect to China, an important update concerns foreign GIs protected under the sui generis system managed by the General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China (AQSIQ). Recently, the “Measures on the Protection of Foreign Geographical Indications Products” (the Measures), have been approved and published. Some important clarifications are provided by such Measures, in particular:

  1. The application for the registration of a foreign GI should be filed by the same applicant as in the country of origin, in cooperation with its national competent authority. Moreover, the applicant must designate its branch in China or an official at its Embassy in China;
  2. The AQSIQ carries out an examination of the formalities as well as a technical one concerning the GI geographical area. In this context, the documents submitted in the framework of a foreign GI application must be officially translated in Chinese;
  3. Once the foreign GI is registered, producers can apply to the AQSIQ for the use of the national GI logo;
  4. Foreign GIs protected in China enjoy equal protection with that accorded to Chinese GIs;
  5. In case of infringements, foreign GIs may address the AQSIQ as well as national courts.

Concerning foreign GIs in China, on top of the ones that have already filled and obtained the GI registration in China (like Champagne, Scotch Whisky and Napa Valley) and the ones protected there under the EU project “10+10” (Comté, Grana Padano, Priego de Cordoba, Prosciutto di Parma, Pruneaux d’Agen, Roquefort, Scottish Farmed Salmon, Siera Magina, West Country Farmehouse Cheddar, White Stilton Cheese/Blue Stilton Cheese) we remind you that the EU is currently negotiating a bilateral agreement with China (see the GIs proposed by the EU). 

 

#Colombia: World Coffee Producers Forum

From July 10th to 12th, 2017, the World Coffee Producers Forum will take place in Medellin, Colombia.

The World Coffee Producers Forum will analyze current challenges faced by the coffee value chain, such as: farmers' economic sustainability, productivity, price volatility, the next generation of coffee growers, the consequences of climate change, quality and traceability, increasing demand by 50 million bags in the next 10 to 15 years.
