12/10/2026-Member’s Voice (I): Monumental decision of the Second Board of Appeal of EUIPO concerning the application for the EUTM “CHAMPAIGN”

On 24 August, the EUIPO 2nd Board of Appeal ruled in the case concerning the application for the EUTM “CHAMPAIGN” in Class 11 (Case R 1446/2025-2).

The Board concluded that the Opposition Division had erred in rejecting the opposition filed by the Comité Champagne against the application and annulled the contested decision.

The Board’s reasoning is particularly interesting in the context of the EU legal framework governing the protection of GIs against the exploitation of their reputation. Among the evidence considered by the Board were declarations from experts and practitioners in the fields of winemaking, gastronomy, kitchen equipment and catering. One of these declarations was submitted by oriGIn and is included in the attached document.
